NWRA Urges Congress to Prevent Proposed Pre-Merger Notification Rules
Arlington, VA – The National Waste & Recycling Association (NWRA) and its coalition allies sent a letter to the chairs and ranking members of the House and Senate Judiciary Committees raising awareness of changes to antitrust policies of the Federal Trade Commission (FTC) and the Department of Justice (DOJ). The new policies place significant burdens on businesses in the early stages of the merger and acquisition phase.
“The proposed changes to the pre-merger notification rules reject the Hart-Scott-Rodino Act standards relied upon by businesses for more than 45 years. Our members depend on regulatory certainty to grow and expand their businesses,” stated Interim NWRA President and CEO Jim Riley. “We urge Congress to prevent the FTC and DOJ from adopting the proposed overhaul of the pre-merger filing requirements.”
This new regulatory regime would require businesses to submit substantial amounts of information in their initial notification. The proposed rule will stifle innovation and affect transactions that could benefit consumers and the U.S. economy. It would impose considerable costs on businesses and inhibit transactions that have no competitive threat.
