ADEM Proposes Revisions to Solid Waste Program Division 335-13, Administrative Code
The Alabama Department of Environmental Management (ADEM) released a notice of public hearing on July 18 regarding proposed revisions to the Solid Waste Program Division 335-13, ADEM Administrative Code.
ADEM indicated that these revisions are being proposed to ensure consistency with state and federal statutes and provide clarification of state requirements for the management of solid waste.
According to the notice, “These changes include updated language to conform to the revised statute for alternate cover material and minor technical revisions to provide better clarity on regulatory requirements or address regulatory concerns. The provisions for obtaining a permit for landfill units, composting facilities and coal combustion residual facilities were relocated to Chapter 5 to provide a single location for all permitting requirements. Additionally, changes were made to the permit modification process to provide greater public participation for certain types of modifications. The department is also proposing to correct several typographical and citation errors in the existing regulations.”
